Welcome to Pawdex. These Terms of Service ("Terms") are a legal agreement between you and Furstenburg Digital LLC, a Florida limited liability company ("Furstenburg Digital," "we," "us," or "our"), governing your use of the Pawdex mobile application and any related services we provide (collectively, the "App").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Please read Sections 13 and 14 carefully. They contain important information about disclaimers, limits on our liability, and your agreement to resolve disputes through binding individual arbitration instead of a court trial. They also contain a waiver of your right to participate in class actions.
You must be at least 13 years old to use Pawdex. If you are between 13 and the age of majority where you live, you may use Pawdex only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. By using the App, you represent that you meet these requirements.
You also represent that you are not located in a country subject to a United States government embargo or designated by the United States government as a "terrorist supporting" country, and that you are not on any United States government list of prohibited or restricted parties.
Pawdex is a mobile app that helps dog owners track and manage information about their dogs, including feeding, vet records, vaccinations, medications, weight, training milestones, and other care information. The App also provides general care guides, checklists, and informational content about dogs.
Pawdex is free to download and use. It contains no advertising. It does not require an account, and all data you enter is stored locally on your device. Optional tips are available through your device's app store; see Section 6 for details.
We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use, in accordance with these Terms and any rules of the app store from which you obtained the App.
This license is granted to you only. You may not lend, rent, sell, transfer, sublicense, or otherwise distribute the App or your license to use it.
When you use Pawdex, you agree not to:
Pawdex is built to keep your data on your device. We do not collect, store, or have access to the information you enter into the App. You are responsible for everything you enter into Pawdex and for keeping a backup of that information if you want to preserve it.
Our handling of any information related to the App is governed by our Privacy Policy, available at https://furstenburgdigital.com/pawdex/privacy. The Privacy Policy is incorporated into these Terms by reference.
You can export your data at any time from within the App and import it on another device. If you delete the App or your device, your data will be deleted with it, and we cannot recover it for you because we never had a copy.
Pawdex offers optional tips you can pay through Apple's in-app purchase system on iOS and Google Play Billing on Android. These tips support our ongoing development of the App. They are entirely voluntary, unlock no features or content, and do not change any aspect of the App's functionality. The entire App works the same whether or not you ever leave a tip.
All tip purchases are processed by Apple or Google, not by us. By making an in-app purchase, you agree to the applicable terms of the App Store or Google Play, including their refund policies. Because tips are voluntary and unlock no content, refunds for tips are handled solely at the discretion of Apple or Google in accordance with their policies. We do not issue refunds for in-app purchases.
If you visit our website at furstenburgdigital.com and choose to leave a tip there, that payment is processed by Stripe. By tipping through our website, you agree to Stripe's terms and our website's terms.
This section is important. Please read it carefully.
Pawdex is an organizational tool. It is not a substitute for professional veterinary care, diagnosis, or treatment.
The care guides, checklists, training content, articles, weight ranges, dosage suggestions, age-based recommendations, and other informational content in Pawdex are provided for general educational purposes only. They are based on common practices and publicly available information about dog care. They are not tailored to your specific dog. They may not be accurate for every breed, age, health condition, or individual animal.
You agree that:
The information in Pawdex is not a prescription, a diagnosis, or a treatment plan. We are not veterinarians. We do not have a veterinary professional relationship with you or your dog. Any decision you make about your dog's care based on information from the App is your decision alone.
If you record information about your dog in Pawdex, such as weight, symptoms, medications, or vaccination dates, the accuracy of that information depends on what you enter. We do not verify the information you log. The App will not catch input errors. You are responsible for confirming all health-related information with your veterinarian.
The care guides, training content, breed information, and other informational material in Pawdex are provided "as is" for general reference. We make no guarantees about the accuracy, completeness, currency, or applicability of this content to your situation. Veterinary science and dog care best practices evolve over time. Some of the content in Pawdex may become outdated. Always check with a current professional source before acting on the information you read in the App.
References in the App to specific products, brands, foods, medications, or services are not endorsements. We do not receive payment for any product or brand mention. We do not have affiliate relationships, sponsorships, or paid placements in the App.
Pawdex, including its name, logo, design, code, written content, illustrations, icons, organizational structure, and all other elements created by Furstenburg Digital LLC, is owned by us and is protected by United States and international copyright, trademark, and other intellectual property laws.
These Terms do not give you any ownership rights in the App. You receive only the limited license described in Section 3.
You retain all rights to the information you enter into Pawdex about your own dog. We claim no ownership of your data.
If you believe any content in the App infringes your copyright, contact us at support@furstenburgdigital.com with a detailed description of the work and the alleged infringement, and we will respond promptly.
The App may connect you to third-party services, including:
We are not responsible for the practices, content, or terms of any third-party service. Your use of these services is governed by the terms and policies of those third parties. If you have a dispute with a third party, you must resolve it directly with them.
The following section applies if you obtained the App from the Apple App Store. By using the App, you and we acknowledge that:
If you obtained the App from Google Play, similar principles apply: these Terms are between you and Furstenburg Digital LLC, not Google. Google is not responsible for the App, its content, or any claims relating to it.
We may release updates to the App from time to time. These updates may add features, fix bugs, address security issues, or make other changes. Some updates may be required for the App to continue working properly. You are responsible for installing updates through your device's app store.
We may modify, suspend, or discontinue the App, in whole or in part, at any time and without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. FURSTENBURG DIGITAL LLC DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION, CONTENT, OR MATERIAL IN THE APP.
YOU USE THE APP AT YOUR OWN RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE APP, CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. IN THOSE JURISDICTIONS, OUR WARRANTIES ARE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FURSTENBURG DIGITAL LLC, ITS OWNERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID US THROUGH IN-APP PURCHASES OR WEBSITE TIPS IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100).
WE ARE NOT LIABLE FOR ANY HARM TO YOUR DOG OR ANY OTHER ANIMAL ARISING FROM YOUR RELIANCE ON THE APP, THE INFORMATION IT CONTAINS, OR THE FAILURE OR ABSENCE OF ANY REMINDER, NOTIFICATION, OR OTHER FEATURE. YOU UNDERSTAND THAT THE APP IS A TOOL FOR ORGANIZING INFORMATION AND THAT THE RESPONSIBILITY FOR YOUR DOG'S CARE RESTS WITH YOU AND YOUR VETERINARIAN.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
You agree to defend, indemnify, and hold harmless Furstenburg Digital LLC and its owners, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the App, (b) your violation of these Terms, (c) your violation of any rights of another person or entity, or (d) your violation of any applicable law or regulation.
You may stop using the App at any time by deleting it from your device. Your license to use the App terminates automatically when you do so.
We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the App. The provisions of these Terms that by their nature should survive termination will survive, including Sections 7, 8, 9, 13, 14, 15, 17, and 18.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. The federal and state courts located in St. Johns County, Florida have exclusive jurisdiction over any claim not subject to arbitration, and you consent to the personal jurisdiction of those courts.
Binding Individual Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App that cannot be resolved informally will be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in St. Johns County, Florida, or by telephone or videoconference at the option of the party initiating arbitration. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver. YOU AND FURSTENBURG DIGITAL LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. UNLESS BOTH PARTIES AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS PROCEEDING. YOU WAIVE YOUR RIGHT TO A JURY TRIAL.
Informal Resolution First. Before initiating arbitration, you agree to first contact us at support@furstenburgdigital.com and describe the dispute in writing, including the specific relief you seek. We will attempt in good faith to resolve the dispute within sixty (60) days of receiving your notice. Arbitration may be commenced only after this informal resolution period has ended without a resolution.
Small Claims Exception. Either party may bring an individual claim in small claims court in St. Johns County, Florida, if the claim qualifies for that court's jurisdiction.
Opt-Out Right. You may opt out of this arbitration agreement by sending written notice to support@furstenburgdigital.com within thirty (30) days of first agreeing to these Terms. Your notice must include your full name and a clear statement that you are opting out of the arbitration agreement. Opting out will not affect any other provision of these Terms.
Federal Arbitration Act. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
We may update these Terms from time to time. When we do, we will post the updated version at https://furstenburgdigital.com/pawdex/terms and update the "Last Updated" date at the top. For material changes, we will also display a notice in the App on the next launch after the update. Your continued use of the App after a change takes effect means you accept the new Terms.
If you do not agree to a change, your sole remedy is to stop using the App.
Entire Agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and Furstenburg Digital LLC regarding the App. They replace any prior agreements or understandings on the subject.
Severability. If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision later or to enforce any other provision.
Assignment. You may not assign or transfer your rights under these Terms. We may assign our rights and obligations under these Terms to any successor, affiliate, or purchaser of our business.
Notices. Any notice we provide to you under these Terms may be given by posting a notice in the App, on our website, or by email if you have provided one. Any notice you provide to us must be sent to support@furstenburgdigital.com.
Headings. Section headings are for convenience only and do not affect interpretation.
Survival. Sections of these Terms that by their nature should survive termination will do so.
